“Make no mistake: No one is above the law, not even the president," New York Attorney General Letitia James stated in the summer of 2019 when she announced her investigation into the Trump Organization.

It was the first salvo in what would become the Democrats’ lawfare campaign against Donald Trump. James herself would arguably score the biggest hit against Trump via a dubious civil fraud case wherein Trump was found guilty of overinflating the value of his properties and had a massive $454 million judgment levied against him. Never mind the fact that Trump’s actions defrauded no one and served to make a lot of money for the lending institutions.

The irony here is that James’s own words, which became her popular refrain in her crusade against Trump, are now coming back to bite her. "No one is above the law,” Ms. James — not even the attorney general of New York.

So, what exactly is James being accused of? The short answer is mortgage fraud.

In a letter sent from Federal Housing Finance Agency (FHFA) Director William Pulte to U.S. Attorney General Pam Bondi and Deputy AG Todd Blanche, he alleges that James “appears to have falsified records in order to meet certain lending requirements and receive favorable loan terms” for at least two properties she purchased. One of those properties is a five-unit building in Brooklyn, and the other is a house in Norfolk, Virginia.

Furthermore, to secure a loan for a property for which her father was a cosigner, she listed him as her husband. As Pulte noted, “While this was a long time ago, it raises serious concerns about the validity of Ms. James’ representations on mortgage applications.” In other words, it would appear that James has a history of falsifying records to obtain favorable mortgages.

Constitutional scholar Jonathan Turley observed that Pulte’s criminal referral to the Justice Department “is quite damning.” Turley pointed out that James’s claim of her Virginia house being her “primary residence” is a misleading statement. “Either it’s your principal residence or it’s not. Either you’re married to your father or he’s your father.”

Turley also noted the rich irony of James now being hit with criminal allegations: “This is a person who prosecuted Trump for everything short of ripping a label off a mattress, and among the charges that were brought in New York, in just the civil but the criminal case, was making false or misleading statements to financial institutions.” He added, “As for James, if we apply the Letitia James standard that she created, there’d be little question here. This seems pretty straightforward.”

A spokesman for the office of the New York AG offered the following statement: “Attorney General James is focused every single day on protecting New Yorkers, especially as this Administration weaponizes the federal government against the rule of law and the Constitution. She will not be intimidated by bullies — no matter who they are.”

Meanwhile, Trump also weighed in via a post on Truth Social: “Letitia James, a totally corrupt politician, should resign from her position as New York State Attorney General, IMMEDIATELY. Everyone is trying to MAKE NEW YORK GREAT AGAIN, and it can never be done with this wacky crook in office.”

Is this simply an example of the Trump administration engaging in a tit for tat, a lawfare campaign against his biggest opponents? That is certainly how James and the Leftmedia talkingheads will spin this. That said, if these allegations prove true, she should be held to account under the law — just as she so repeatedly claimed to have done with her archnemesis, Donald Trump.
